Getaway Club Code of Ethics

The Getawayclub Policy Guide is a reference for Members who want to learn more about the way this opportunity works. It includes ethical guidelines, contractual obligations, and the policies that relate to becoming a Member.

The guide also includes rules of the Compensation Plan and managing your account. Because federal, state, provincial, foreign and local laws change, the company reserves the right to amend or revise these Policies and Procedures and its prices at its sole and absolute discretion.

The Getawayclub uses the term Member, Independent member, Marketing Consultant as one and the same. When you register as an Independent Member of Getawayclub, you agree to follow and be bound by the Company Code of Ethics and all the Policies and Procedures which are incorporated into the Member Application. Violations of the Company Code of Ethics, Member Agreement, or the written Policies and Procedures may be cause for cancellation of Membership. Please read through these Policies and Procedures carefully to fully benefit and understand your rights and responsibilities as a Getawayclub Member.

Getawayclub is a company that prides itself on the quality, values and character of its Members. These guidelines help insure a uniform standard of excellence throughout our organization. Every Getawayclub Member is expected to practice the following ethical behavior when acting in the name of the company:

• I will be respectful of every person I meet while doing Getawayclub related business.
  
• I will conduct myself and my business in an ethical, moral, legal and financially sound manner at all times. I will not engage in activities that would bring disrepute to the Getawayclub, any Getawayclub corporate officer or employee, myself, or other Members.
  
• I will not make discouraging or disparaging claims directed toward other Getawayclub Members. I will refrain from using any type of slanderous statements, implications or assumptions, when representing Getawayclub.
  
• I will provide support and encouragement to my introductions to ensure that their experience with Getawayclub is a successful one. I understand that it is important to provide follow-up service and support to my downline.

Your Relationship to the Getaway Club

1. You will be bound by any amendments upon notification through any of Getawayclub's official channels of communication. Those channels of communication include, but are not limited to, posting of information to the Getawayclub website or email to the Members.
2. An Applicant/Person becomes an approved member on the date the application is received and accepted by the company.
3. A member must submit all their details as per the application form. This includes their correct and legal name, address and contact details. This is required to prevent fraud and help authenticate the members details.
4. Any account, applicant or member with false, misleading or inaccurate information, will be suspended or terminated and may have the funds attributed to this account, applicant or member seized at any time without notice.
5. An application that is incomplete, incorrect, or fraudulent in any respect will be invalid and of no force or effect. If a member fails to provide the required documentation, the company may declare a contract void from its inception and may recoup any Bonuses paid. An applicant or member is prohibited from submitting any false or inaccurate information to the company.
6. On any website that you use, whether a Getawayclub provided site or one you develop yourself, you must implement a privacy policy that protects any information gathered from the website from being sold or used by anyone else.
   
7. You may not Spam. Spamming includes, but is not necessarily limited to: 1) Sending unsolicited email messages that contain any email or web addresses from your account to online users. 2) Posting messages that contain your service address in news groups that are unrelated to your products or service. 3) Creating false “from sources” in an email message, or
   newsgroup posting with your service address, thereby giving the impression that the message originated from Getawayclub or its network of independent distributors. 4) Sending unsolicited emails to lists of people that are not within your downline or with whom you have no prior business or personal relationship. All Getawayclub -related email broadcasts must only be sent to your downline. Wmail must not contain any false representations, income claims, or testimonials. All business/product  content must be pre-approved and found on Getawayclub corporate literature.
8. All cards, letterheads, signs, advertising materials, and verbal conversations, etc. used to promote business must make it clear that you are an independent distributor. They may not imply or state that you are an agent, authorized representative, employee, joint venture or franchisee of Getawayclub.
   
9. if you advertise via newspaper or other advertising venues, the following rules apply:
   • No advertisement may imply that a job or position is available.
   • No specific income can be promised.
   • Advertisements may not contain references to Getawayclub or its products.
10. The getawayclub access to Travel benefits and discounts is renewable annually.

You agree to release and discharge Getawayclub and its successors, assigns, employees, and agents, from any and all liability, monetary compensation, claim and/or demand arising out of or in connection with the creation and the use of any photograph, video, audio, or endorsement, including any claim for defamation.

USER AGREEMENT
(“Agreement”)
ACCEPTANCE OF TERMS THROUGH USE by using this site or by clicking “I agree” to this Agreement, you (“User”) signify your agreement to these terms and conditions. If you do not agree to this Agreement please do not use this site and do not click “I agree”. Please check this Agreement periodically for changes as the owner of this site (“Company”) reserves the right to revise this Agreement and your continued use of this site following the posting of any changes to the Agreement constitutes acceptance of such changes. The Company reserves the right to terminate a User’s use of this site at any time without notice and may do so for any breach of this Agreement or the instructions on this site by User. This Agreement applies to licensors and advertisers as well.

You agree that if you are issued a Username and Password by the Company, you shall use your best efforts to prevent access to this site through your Username and Password by anyone other than yourself, including but not limited to, keeping such information strictly confidential, notifying the Company immediately if you discover loss or access to such information by another party not under your control and supervision, and by using a Username and Password not easily guessed by a third party.

You agree that you shall not try to reverse engineer, reverse assemble, reverse compile, decompile, disassemble, translate or otherwise alter any executable code, contents or materials on or received via this site. You understand that such actions are likely to subject you to serious civil and criminal legal penalties and that the Company shall pursue such penalties to the full extent of the law to protect its rights and the rights of its other licensors.

TRADEMARKS
The Company’s, licensors’ or other third party materials, services or products referenced on this site are common law or registered trade marks or service marks of such parties.

INDEMNIFICATION
You agree to defend, indemnify, and hold harmless the Company, its advertisers, licensors, subsidiaries and other affiliated companies, and their employees, contractors, officers, agents and directors from all liabilities, claims, and expenses, including attorney's fees, that arise from your use of this site, or any services, information or products from this site, or any violation of this Agreement. The Company reserves the right, at it own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you shall cooperate with the Company in asserting any available defenses.

LEGAL COMPLIANCE
Company may suspend or terminate this Agreement or User’s use immediately upon receipt of any notice which alleges that User has used this site for any purpose that violates any local, state, federal or law of other nations, including but not limited to the posting of information that may violate third party rights, that may defame a third party, that may be obscene or pornographic, that may harass or assault others, that may violate hacking or other criminal regulations, etc. of its agents, officers, directors, contractors or employees. In such event, Company may disclose the User’s identity and contact information, if requested by a government or law enforcement body or as a result of a subpoena or other legal action, and Company shall not be liable for damages or results thereof and User agrees not to bring any action or claim against Company for such disclosure.

MISCELLANEOUS
This Agreement incorporates by reference the Site Submission Rules if this site allows posting and posts such Rules. This Agreement constitutes the entire agreement between the parties related to the subject matter thereof, supersedes any prior or contemporaneous (oral, written or electronic) agreement between the parties and shall not be changed except by written agreement signed by an officer of the Company. If any provision of this Agreement is prohibited by law or held to be unenforceable, the remaining provisions hereof shall not be affected, and this Agreement as much as possible under applicable law shall continue in full force and effect as if such unenforceable provision had never constituted a part hereof and the unenforceable provision shall be automatically amended so as to best accomplish the objectives of such unenforceable provision within the limits of applicable law. User shall not assign or transfer this Agreement and any such transfer shall be void.

• SALES PAYMENTS - Income generated from marketing commissions of sales of the GETAWAYCLUB CARD will be deposited into each member’s account by the 7th day following the completion of cycling off a Board.
  
• DOWNLINE and BOARD REPORTS-Members can view their personal downline report and boards online anytime by entering their members area with password.

Site Submission Rules
By using features of this site that allow you to post or otherwise transmit information to or through this site, or which may be seen by other users, you agree that you shall not upload, post, or otherwise distribute or facilitate distribution of any content -- including text, communications, video, software, images, sounds, data, or other information that:

CHANGE OF ADDRESS AND/OR PHONE NUMBER AND EMAIL ADDRESS - It is the responsibility of the member to Edit and update any change of address, telephone number, or E-mail address. This can happen by going into the members area on your website using the username and password that was given by you upon registration This will ensure that all members’ details are kept up to date.

You also agree that you shall not harvest or collect information about the users of this site or use such information for the purpose of transmitting or facilitating transmission of unsolicited bulk electronic e-mail or communications for any other commercial purpose of your own or a third party. You further agree that you shall not solicit or collect information, or attempt to induce any physical contact with, anyone 18 years old or younger without appropriate prior verifiable express parental consent. This site generally does not pre-screen, monitor, or edit the content posted by users of this site. However, this site and its agents have the right, at their sole discretion, to remove any content that, in this site’s sole judgment, does not comply with the Site Submission Rules or is otherwise harmful, objectionable, or inaccurate. This site is not liable for any failure, delay, damages or results, in removing such content.
